7. Service-Specific Terms
The following terms apply specifically to our advisory and support services:
Scope of Work
Each engagement is governed by a written engagement letter that defines the scope of work. Work outside the agreed scope will require a separate arrangement and may incur additional fees.
Timelines
We work at a considered pace appropriate to the sensitivity of inheritance matters. Timelines depend on court scheduling, government agency processing times, and the completeness of information provided. We will keep you informed throughout.
Client Cooperation
Delays caused by incomplete information, unavailable documentation, or slow responses from you or third parties are outside our control. We will advise you clearly on what is needed at each stage.
Confidentiality
We treat all information shared with us in the course of an engagement as strictly confidential. We will not share your personal or case information with third parties except where required by law or with your explicit consent.
8. Disclaimers
Our website and its content are provided for general information purposes only. Nothing on this website constitutes formal legal advice. We encourage you to speak with us directly about your specific circumstances before making any decisions.
While we take care to keep information on our website accurate and current, we do not warrant that it is complete, free from error, or appropriate for your particular situation. Laws and regulations in Malaysia may change, and website content may not always reflect the most recent developments.
We provide our services with reasonable care and skill, but we cannot guarantee outcomes in matters involving court processes, government agencies, or the cooperation of third parties.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Saka's liability to you in connection with our services or website is limited to the fees paid by you for the specific service giving rise to the claim.
We are not liable for:
- Indirect or consequential loss, including loss of income or opportunity.
- Delays or outcomes caused by third parties, government agencies, or courts.
- Loss arising from your reliance on general information on our website without engaging our services.
- Circumstances beyond our reasonable control (force majeure), including natural events, system outages, or changes in law.
Nothing in these terms limits liability for fraud, gross negligence, or any other liability that cannot lawfully be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold Saka, its advisers, and staff harmless from any claims, losses, or expenses (including reasonable legal costs) arising from:
- Your breach of these Terms and Conditions.
- False or misleading information you provide to us.
- Your unlawful use of our website or services.
- Any claim by a third party arising from your conduct in connection with your matter.
11. Termination
Either party may end an engagement by giving reasonable written notice. We will complete any work in progress where it is practical and fair to do so, and we will provide you with a summary of the position at the time of termination.
We may cease providing services to you immediately if:
- You provide false or misleading information that is material to the engagement.
- Continuing the engagement would place us in breach of any applicable law or professional obligation.
- You act in a manner that is abusive or threatening toward our staff.
Upon termination, provisions relating to intellectual property, confidentiality, liability, and dispute resolution continue to apply.
12. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from your use of our website or services is subject to the exclusive jurisdiction of the Malaysian courts.
Before initiating any formal proceedings, we encourage you to contact us directly at [email protected] so that we can explore an informal resolution. Most concerns can be addressed through open conversation, and we are committed to responding thoughtfully and promptly.
If informal resolution is not possible, mediation through a recognised Malaysian body may be proposed by either party before litigation is pursued.
13. General Provisions
- Entire Agreement: These Terms and Conditions, together with any engagement letter, constitute the full agreement between you and Saka regarding the matters covered.
- Severability: If any provision of these terms is found to be invalid or unenforceable, it will be removed without affecting the remaining provisions.
- Waiver: Our failure to enforce a provision on any occasion does not waive our right to enforce it in the future.
- Assignment: You may not assign your rights or obligations under these terms without our written consent. We may assign our obligations to a successor firm providing comparable services.
- Notices: Written notices under these terms should be sent to [email protected] or by post to our registered address.
